Domestic corporations generally treat their Intellectual Property matters in one of three different ways, each of which provides service opportunities for the Michaud-Duffy Group LLP.
Those companies with legal departments that include Intellectual Property counsel will either handle some of their Intellectual Property work in-house and assign overflow work to outside counsel. Oftentimes, the in-house Intellectual Property counsel will act as liaisons between the corporation and outside Intellectual Property counsel. In this situation the Michaud-Duffy Group LLP would do the Intellectual Property work as directed.
Corporations whose legal departments have no Intellectual Property Counsel or who do not have a legal department will engage the services of the Michaud-Duffy Group LLP to function as that company's Intellectual Property department. In this situation the Michaud-Duffy Group LLP would work with the General Counsel but would be responsible for interfacing with company personnel, mainly inventors, and draft all of the Intellectual Property documents, as well as maintaining the company's Intellectual Property portfolio.
Companies having no legal departments would also generally retain the services of the Michaud-Duffy Group LLP to handle all of their Intellectual Property matters with the firm interfacing with inventors and other corporate personnel. In all of these situations, the Michaud-Duffy Group LLP would be responsible for handling and overseeing all of the foreign intellectual property matters for the corporate clients.
Foreign corporations desiring intellectual property protection in the United States must retain the services of U.S. Intellectual Property attorneys. Accordingly, the Michaud-Duffy Group LLP would typically receive patent applications or be asked to file trademark applications that have been filed in the foreign corporations country initially. The Michaud-Duffy Group LLP would prepare these applications in accordance with United States practice and file them on behalf of the foreign corporation. The subsequent prosecution would also be handled by the Michaud-Duffy Group LLP.
The Michaud-Duffy Group LLP also has a significant foreign practice wherein work is received directly from many large, significant foreign corporations. Work received directly from foreign associates (foreign law firms) is handled in the same manner as work received from foreign corporations.
